Board of Health Meeting

NOVEMBER 19, 2009
A regular posted meeting of the Hingham Board of Health (the Board) was held in the South Hearing Room, 210 Central St. Hingham, Massachusetts.
The meeting was called to order by Dr. Shilts at 6:16pm.

Ann Miller, Assistant Health Clerk

AGENDA
Mr. Capman reviewed the meeting’s agenda with the Board.
Thereafter, the agenda was accepted with additions.

SEPTIC SYSTEM VARIANCE REQUEST
498-500 MAIN STREET
The Board reviewed a homeowner request for variances from State Title-V and Hingham Supplemental septic regulations relative to a failed sewage disposal system.

The Board reviewed the following documents:
• Report from Mr. Capman dated 11/18/09
The Board discussed the following issues:
• The proposed system will service two (2) 3-beedroom units.
• The proposal appears to meet maximum feasible compliance.
Thereafter, a Motion was made by Mr. White and Seconded by Mr. Bickford and it was VOTED (unanimous);
To grant a Divergence from State Title-V regulation 15.405(1)(a), and Variances from the Hingham Supplemental septic Rules and Regulations sections VI.9 & VI.12(a), and conditional on the nine (9) conditions outlined in Mr. Capman’s 11/18/09 report.

EXECUTIVE HEALTH OFFICER’S REPORT:
 Hingham Industrial Park Study/ Pond Park Drive
Mr. Capman reviewed with the Board an overview of two proposed developments planned for the Hingham Industrial Park area. Dr. Shilts provided the Board with a copy of his 11/13/09 letter to Town Planner Katie Lacy concerning his review of a scope of services agreement regarding the Industrial Park area.

 Seasonal Flu Clinic
Mr. Capman stated that the next seasonal flu clinic is scheduled for Saturday, 11/21/09, at the Hingham Town Hall.

 H1N1 Flu Vaccinations
Mr. Capman stated that the Health Dept. is currently offering H1N1 vaccine to pregnant women by appointment only. He added that a full-scale vaccination clinic is being planned for early December, dependent upon receipt of additional and adequate supply. He confirmed that providing H1N1 vaccinations would be operated via the town’s Emergency Dispensing Site (EDS) process, and this would be the first time utilizing the EDS and its protocol.

 Hingham Health Agent
Mr. Capman mentioned that he would start the process to fill the available position of Health Agent around mid January 2010.

MINUTES
The Board reviewed the draft public meeting minutes of September 23, 2009.
Thereafter, a Motion was made by Mr. Bickford and Seconded by Mr. White and it was VOTED (unanimous);
To approve the minutes of September 23, 2009 as presented.

The Board reviewed the draft public meeting minutes of October 15, 2009.
Thereafter, a Motion was made by Mr. White and Seconded by Mr. Bickford and it was VOTED (unanimous);
To approve the public meeting minutes of October 15, 2009 as presented.

HEALTH DEPARTMENT PERSONNEL
Mr. Capman stated that both parties have signed the separation agreement between the Board and former Health Dept. employee Michael McDonald.
Thereafter, a Motion was made by Mr. White and Seconded by Mr. Bickford and it was VOTED;
To enter into EXECUTIVE SESSION pursuant to MGL c.39, § 23B(3) at 8:36pm for a period of approximately ten (10) minutes to discuss litigation strategy relative to non-union personnel.
