Board of Health Meeting

 APRIL 15, 2010
A regular meeting of the Hingham Board of Health (the Board) was held in the South Central Hearing Room, 210 Central St. Hingham, Massachusetts. 
The meeting was called to order by Dr. Shilts at 6:41PM.

MEMBERS PRESENT

AGENDA

Mr. Capman reviewed the meeting’s agenda with the Board.

Thereafter, the agenda was accepted with additions.

MINUTES
The Board reviewed the minutes of the 3/18/10 public meeting.
Thereafter, a Motion was made by Mr. Bickford and Seconded by Mr. White and it was VOTED (unanimous);
To approve the minutes of March 18, 2010 as amended.

SEPTIC SYSTEM VARIANCE REQUEST:
3 SEAL COVE ROAD
      The Board continued the discussion from the previous March 18th meeting on this request for a variance from the Hingham Supplemental (septic) regulations.

      The Board reviewed the following documents:

Thereafter, a Motion was made by Mr. Bickford and Seconded by Mr. White and it was VOTED (unanimous);
To close this matter due to the withdrawal of the application.

ANIMAL PERMIT APPLICATIONS:
133 LEAVITT STREET
The Board reviewed a 1/8/10 Animal Facility application.
Permit applicant: Geoff & Signe McCullough
The Board reviewed the following documents:

The Board discussed the following issues:

Thereafter, a Motion was made by Mr. White and Seconded by Mr. Bickford and it was VOTED (unanimous);
To deny the animal Facility application as submitted.

12 POPES LANE
The Board reviewed a 12/28/09 Animal Facility application.
Permit applicant: Joanne McGuirk
The Board reviewed the following documents:

Thereafter, a Motion was made by Mr. Bickford and Seconded by Mr. White and it was VOTED (unanimous);
To grant the following variances to the Town of Hingham Regulations Governing the Keeping of Animals and Fowl sections 3-4(B): (the facility located less than 100 feet from a wetland is allowed), and 3-7(D)(1): (distance of manure storage within 100 feet of a wetland is allowed), and issue a permit to keep animals through 12/31/10.

272 WHITING STREET
The Board reviewed a 12/28/09 Animal Facility application.
Permit applicant: Anthony Nezarrella
The Board reviewed the following documents:

Thereafter, a Motion was made by Mr. Bickford and Seconded by Mr. White and it was VOTED (unanimous);
To issue a permit to keep animals through 12/31/10.

EXECUTIVE HEALTH OFFICER’S REPORT:

Mr. Capman reviewed with the Board a 3/5/10 letter from Town Administrator Paicos regarding a formal legal notice of no-trespass to Mr. McDonald upon his entering or engaging in any activities on Town Hall property, including his being subject to legal process or arrest for violation of said notice.

Mr. Capman updated the Board regarding this matter from the previous March 18th meeting.  He provided the Board a copy of his 3/23/10 letter to Ms. Jennifer Turcotte, Director of Engineering, Green Environmental Inc., and his personal notes from a 4/7/10 meeting with Ms. Turcotte and Mr. Glenn Harrington regarding this issue.  
Thereafter, a Motion was made by Mr. Bickford and Seconded by Mr. White and it was VOTED (unanimous);
To express a notice of deep concern with the unacceptable billing practices of Green Environmental Inc. regarding invoice #11791.

Mr. Capman discussed with the Board a revised state statute that establishes town permitting and water quality testing requirements for semi-public and neighborhood beaches.
Thereafter, a Motion was made by Mr. Bickford and Seconded by Mr. White and it was VOTED (unanimous);
To establish a beach permit fee of $300 for all Hingham semi-public and neighborhood beach associations.

Mr. Capman discussed with the Board his recommendations for filling the open position of Health Agent.
Thereafter, the Board instructed Mr. Capman to post the open Health Agent position at equal to or less than 30-hours per week.

CORRESPONDENCE:
¨ AFFILIATED MONITORS, Inc.
The Board reviewed a March 2010 letter from Affiliated Monitors regarding their professional services.

SCHEDULING
The next meeting is scheduled for Thursday, May 20, 2010.

ADJOURNMENT
The April 15, 2010 meeting of the Hingham Board of Health adjourned at 7:58PM.
