A regular meeting of the Hingham Board of Health (the Board) was held in the South Central Hearing Room, 210 Central St. Hingham, Massachusetts.

DEFINITIVE SUBDIVISION APPLICATION
987 MAIN STREET, SPRAGUE COURT
The Board took up the matter of this definitive subdivision request.

Thereafter, a Motion was made by Mr. White and Seconded by Dr. Shilts and it was VOTED (unanimous);
To approve the ‘Sprague Court’ 987 Main St. definitive subdivision relative to the submitted “Waiver Plan” dated 1/4/11 that depicts two (2) lots, each containing a three-bedroom dwelling, and forward this favorable recommendation to the Planning Board.
SEPTIC SYSTEM VARIANCE REQUEST
24 GILFORD ROAD
The Board reviewed a homeowner request for variances from State Title 5 and the Hingham Supplemental (septic) regulations relative to a failed septic system.

Thereafter, a Motion was made by Dr. Shilts and Seconded by Mr. White and it was VOTED (unanimous);
To grant three (3) Divergences from State Title-5 regulations, 15.405(1)(a), 15.405(1)(g) & 15.405(1)(d); and two (2) Variances from the Hingham Supplemental (septic) Rules and Regulations sections VI.9 & VI.12(a); and conditional to the eleven (11) conditions outlined in Mr. Capman’s 12/6/10 report; and conditional to a twelfth requirement that a notice be added to the property’s deed identifying the presence of an Innovative/Alternative septic system.
SWIMMING POOL LIFEGUARD WAIVER REQUEST
300 LINDEN PONDS WAY, LINDEN PONDS
The Board reviewed a request from Ms. Jenna Carter, Linden Pond’s wellness manager, to have the locally-mandated requirement of an on-duty lifeguard waived for the Linden Ponds semi-private indoor pool facility.

Thereafter, a Motion was made by Dr. Shilts and Seconded by Mr. White and it was VOTED (unanimous);
To grant a waiver from the State regulations concerning pools waiving the requirement, through the last day of 2011, that a lifeguard must be on duty for the Linden Ponds indoor pool on Monday through Friday from 5am-7am & 6pm-9pm, Saturday from 5am-8am, and Sunday from 5am-11am; conditional to the nine (9) conditions outlined in Ms. Jenna Carter’s 12/1/10 letter.
SWIMMING POOL LIFEGUARD WAIVER REQUEST

A representative from the Avalon Communities reportedly requested a postponement on their waiver request.
Thereafter, no action was taken on this matter.
EXECUTIVE HEALTH OFFICER’S REPORT:
Mr. Capman reviewed with the Board a 12/17/10 letter from James Colman of the State DEP outlining the transfer of responsibility for permitting solid waste transfer stations, which accept 50 tons or less of refuse per day, from the State DEP to the local municipal boards of health. This change will reportedly become effective on 7/1/12. Mr. Capman added that the State has already begun educational programs directed toward this planned transfer.
Mr. Capman reviewed with the Board a 12/16/10 memo from the Planning Board concerning eleven proposed zoning-related Articles for 2011 Town Meeting.
MINUTES
The Board reviewed the minutes of the 12/17/10 public meeting.
Thereafter, a Motion was made by Dr. Shilts and Seconded by Mr. White and it was VOTED (unanimous);
To approve the minutes of December 8, 2010 as amended.
SCHEDULING
The next meeting of the Board of Health was not scheduled.
