and Gary Tondorf-Dick.  Also present was Planner Katharine Lacy.

Mr. Healey opened the public meeting at 7:00 P.M. at the Hingham Town Hall.

RE:  New East School-O Collins Street Site Plan Review Hearing/Parking Determination

Present for the Applicant: Scott Dunlap, AI Architects; Dot Gallo, Superintendent of the Hingham Schools.

Present for the Town: John Chessia, Chessia Consulting.

Mr. Healey noted that this was a continuation of the hearing on the proposed new East School. John Chessia reported that since the last hearing he had been in contact with the applicant's engineers, and the bulk of his outstanding concerns had been addressed.

Board discussion focused on the Police's concern that the traffic study submitted with the application was insufficient, and their request for additional information on the combined impacts of the new school and the Greenbush Station at Nantasket Junction. Board members concluded that it would be best to conduct this study after the school and station were operational. Superintendent Gallo asked whether the School Department would be responsible for funding any mitigation identified in the study and Board members responded that in light of the fact that this was a Town project the Town would end up paying for needed improvements one way or another. That said, they acknowledged that it did not seem appropriate to require mitigation from the School Department. Instead, the recommendations generated from such a study would be used by the Town as a whole for planning purposes.

Another outstanding issue was whether the place safety fencing around Detention Basin B. The Board determined that fencing should be required to ensure safety.

At the conclusion of the hearing, the Board made the following votes:

1. Special Permit A-3 (Parking Determination)
The Planning Board voted unanimously to GRANT the Applicant a Special Permit A-3 under Section V-A on the determination that the proposed number of parking spaces (150) was sufficient for the proposed use.

2. Site Plan Approval
The Planning Board voted unanimously to APPROVE the Site Plan for the New Hingham Elementary School, dated May 14, 2007 with revisions to July 12, 2007, subject to the following Site Plan conditions which shall be included as conditions to the Building Permit:

1. The proposed design shall comply with the requirements of the Police and Fire Department relative to traffic circulation, emergency access and parking.  The recommendations of the Traffic Consultant shall be incorporated into the design, in particular off-site improvements shall be installed subject to any other required approvals.  On-site pavement markings and signage shall be


provided that indicate parent and bus loading and drop off areas and identify no-access zones and times.

2. One year after occupancy of the school, the applicant shall work with the Hingham Police Department to hire a qualified professional to conduct a Traffic Study to analyze traffic conditions in the vicinity of the school, and identify and provide cost estimates for mitigation measures as appropriate. It is anticipated that this study will include, at a minimum, traffic counts at 1) the school exit drive and 2) North and South on 228 from Eastgate Lane, as well Level of Service (LOS) analyses at the following intersections:

Summer Street @ East Street
Kilby Street @ Summer Street
Summer Street @ 3A
Kilby Street @ 3A
East Street (228)@3A
East Street @ Winter/Spring/Leavitt
Hingham Center (East@Main/Middle/School)

The final Scope of Work for the Study, including the list of intersections to be studied, will be approved by the Hingham Police Department.

3. Cross section details of both proposed drainage basins shall be included in the final construction drawings, including stone details

4. Final construction plans shall show a cascade grate on SCB #1.

5. Final construction plans shall include safety fencing (preferably screened with vegetative landscaping) around the north and east sides of Detention Basin B

6. Prior to the issuance of a Building Permit, the Board of Health shall issue a Disposal Works Construction Permit for the proposed septic system.

7. Prior to the issuance of a Building Permit the applicant shall provide a letter from Aquarion shall issue a letter indicating that there is available water supply.

8. Prior to the issuance of a Building Permit, the applicant shall provide construction phase erosion and sedimentation control plan.  The plan should indicate temporary stockpile locations, proposed temporary sedimentation basins, erosion control measures, trailer locations, etc.  The plan should include notes specifying standard periodic inspection requirements and reporting to the appropriate Town agencies including a specific rainfall depth (1" recommended) after which an inspection should be performed.  Erosion controls shall not encroach on the wetland limits.

9. Prior to the issuance of an Occupancy Permit, the applicant shall provide a stand-alone Operations and Maintenance Plan including the following requirements:

a. Catch basins are to be inspected four times a year and cleaned twice per year. 

b. Detention/Retention basins are to be inspected semi-annually.

c. Stormceptor and Vortechnic units are to be inspected at least four times a year and cleaned at least twice per year.  Manufacturers instructions for maintenance and cleaning of these units shall be included and made a part of the O&M plan. 

The plan should also include information on frequency of mowing of vegetated slopes, and clearly designate the responsible party for implementation of the O & M plan. 

10. Groundwater at retention/detention basins shall be confirmed during seasonally high groundwater period in the spring.  If the basin holds water for an extended period of time in the spring it may be necessary to raise the elevation of the bottom of the basins. 

11. Any changes required in the plans that vary from the Zoning Board of Appeals decision shall be approved by the Zoning Board of Appeals.

The hearing was continued to August 6 at 7:00 PM.

RE:  Revisions to the Planning Board Regulations for Site Plan Review and Special Permits A3 per 2007 Town Meeting Article 25

Ms. Lacy noted that the 2007 Town Meeting Article 25 included a number of changes to the process for Site Plan approval, and these need to be incorporated into the Board's regulations for Site Plan Review and Special Permits accordingly. The Board approved this change. Additionally, the Board now needs to appoint an alternate for Special Permit hearings. Board members reviewed the list of ZBA alternates and identified those that they would contact about serving as an alternate. Bill Ramsey was appointed as the alternate member of the Planning Board for Special Permits A3.

RE:  Old/New Business

It was moved, seconded, and  SO VOTED, unanimously, by those present to accept the minutes of June 25, 2007.

Status of Approved Subdivisions
Ms. Lacy reported that in an effort to get a better handle on on-going projects, she had written letters to the 12 ongoing subdivisions to request that they contact us to let us know their plans for completion and, if needed, request an extension. There are several developers who should pursue street acceptance for their roadways at the 2008 Town Meeting (Hilltop Road, Julian Waye, Gardner Woods, Cranberry Lane). For the roads that were intended to remain private, there is a process for final approval and covenant release outlined in the Subdivision Regulations

Update on Revisions to Subdivision Rules and Regulations
Ms. Lacy asked if 1-2 Planning Board members would serve as a kind of subcommittee to review the draft material from Horsley and Witten received to date. Paul Healey and Gary Tondorf-Dick volunteered. 

August Meeting Schedule
Ms. Lacy polled the Board about availability in August for meetings. There will be a meeting on July 30, August 6, and August 20 or 27.
