 118 North Street, The Snug - Request to waive requirement for Site Plan Review
 Form A Boston Golf "Cottage Lot"

Murphy, and Gary Tondorf-Dick.  Also present was Planner Katharine Lacy.

RE:  Hingham Shipyard-Samuels and Associates Compliance with Conditions
Leslie Cohen and Mike Fitzpatrick came before the Planning Board to follow up on conditions included in the Site Plan Approval issued by the Planning Board on March 14, 2008 relative to the changes to the Samuels plan required to accommodate the Fresh Market (located in Building K).

Condition A (3) of the Site Plan Approval requires that the Planning Board review the final elevations and exterior design of Buildings B and K. In response to these conditions the applicant submitted proposed elevations and floor plans for Buildings B and K dated June 2, 2008 showing the proposed building modifications. Additionally, at the hearing, the applicant provided a three dimensional model of the entire Samuels development which also incorporated the proposed changes.

Board members voted to approve the modified plans for Building B and Building K subject to the following condition:

That the color of the main, bi-level roof on Building K be changed from green, as shown on the plans, to grey, consistent with the other buildings on the Samuel's Site, provided however, that green may be used as an accent color on the front portico and other decorative features of the building.

Condition B(2) required the Applicant (a) verify in writing to the Planning Board the design vehicle used to determine the adequacy of the loading area for Building K and shall submit a modified loading area plan if necessary to accommodate the vehicles intended to use such loading area and (b) submit to the Planning Board for review and approval a modified form of the Circulation Plan which presents an alternative truck access route to Building K from Shipyard Drive East.

In response to this condition the applicant provided a Truck Circulation Plan dated June 2, 2008 which accomplishes both of the requirements included in the condition. This plan shows a WB-67 truck, which is the largest delivery vehicle to be received at Building K. The truck will enter the site from Shipyard Drive East and will exit through Essington Drive. 

Board members concurred that the plan submitted satisfied the condition, but expressed concern that the turning radii still appeared to be a bit tight.  The Planning Board voted to approve the 6/2/08 Traffic Circulation Plan with the following condition:

"In the event the Building Commissioner or Chief of Police determines that the truck circulation route shown on the 6/2/08 Traffic Circulation plan results in conflicts with parked cars or pedestrians, the applicant shall be subject to conditions relative to truck size and/or hours of delivery."

Old/New Business

Heather Lane As-Built
Rick Grady of Grady Consulting had dropped off revised as-built plans for Heather Lane, which is an accepted roadway, reflecting a chance in the location of the drainage easement over Lot 3. This change had been approved by the Hingham DPW to accommodate the owner of Lot 3, but it was necessary to modify the as-built plan on record to reflect the final easement location. Ms. Murphy asked whether this kind of change wouldn't require a vote of Town Meeting, since it addressed a Town interest in real estate. Ms. Lacy said that she would follow up with the Selectmen's Office to find out, and Board members signed the revised as-built.

2) Form A  Boston Golf Clubhouse Lot
This Form A will remove the lot lines from around the "cottage lot" created several years ago to facilitate the construction of the owner's cottage and Boston Golf, with the effect of merging the lot into the rest of the property. It was moved, seconded, and SO VOTED to endorse the Form A titled "Approval Not Required Plan of Land, 400 Cushing Street, MA 02043," dated May 16, 2008, prepared by Coler and Colantonio, Engineers and Scientists, Norwell, MA for Boston Golf Club, 289 Whiting Street Hingham MA, owner and applicant.

3) The Snug
Ms. Lacy explained that Ed Brown of the Snug filed an application for a Special Permit A2 from the ZBA for the expansion of his restaurant use onto the adjacent alley. The Planning Board held a public hearing and issued a fairly thorough Parking Determination (Special Permit A3) in August, 2007. This property is located in the Downtown Overlay District and, as such, is subject to Design Review by the Historic Districts Commission under Section III-G (5).

The Board VOTED in accordance with Section I-I (5) of the Hingham Zoning By-Law, to waive the requirement for Site Plan Review relative the Application for a Special Permit A2 for the Snug to construct a 26-seat outdoor patio. This decision was made on the basis that the Board had already reviewed the project in association with their issuance of the Special Permit A3 (Parking Waiver) on August 27, 2007. This decision effectively limits the number of seats that can be provided in the proposed outdoor seating area to 26.

Board member Gary Tondorf-Dick expressed concern about the accessibility of the patio area for handicapped customers and/or employees but acknowledged that this would be best addressed by the Building Commissioner in his review of compliance with the Americans with Disabilities Act (ADA).

3) Summer Schedule

Board Members agreed on the following tentative meeting schedule for the summer:

June 30, July 7, July 14 (Judy will not be there); July 21 (Sarah will not be there); August 11; September 8
