Present: Planning Board Members, Sarah Corey, Chair, Paul Healey, Susan Murphy, and
Gary Tondorf-Dick. Also present was Planner Katharine Lacy.

RE: Meeting with Mark Bobrowski regarding 26 Summer Street Request to Modify Site Plan Review Condition #1
The Planning Board received a letter from Attorney Mark Bobrowski on behalf of the Zoning Board of Appeals, dated August 29, 2008 requesting, that the Planning Board reconsider Condition #1 of the Site Plan Approval for 26 Summer Street dated April 15, 2008. Condition #1 reads as follows:

1. For the uses approved by the Zoning Board of Appeals for the site the Applicant shall provide at least 80% of the total number of parking spaces required in the off-street parking regulations set forth in section V-A, 2 of the Zoning By-Law, without further reduction as such 80% parking requirement includes a 10% reduction for coincident uses pursuant to Note b of such Section and a further 10% reduction due to the seasonal uses on the property.

The request to reconsider was made by the ZBA, in accordance with Section I-I (2) c, which states that.

“The Board of Appeals may propose to the Planning Board the modification or removal of a site plan condition imposed by the Planning Board. Failure of the Planning board to issue a revision to the site plan conditions within 21 days shall be deemed a denial of that proposal.”

Attorney Mark Bobrowski met with the Board to discuss this request, and advised that they go into executive session to discuss it further.

Board members were polled by the Chairman, and they all voted to go into executive session at 7:10 PM.

The Board came out of executive session at 7:43 PM.

Judy Sneath, Planning Board member, joined the meeting at this point.

RE: Planning Board Training with Massachusetts Office of Dispute Resolution
Lorraine Della Porta and M.J, Shultz of the Massachusetts Office of Dispute Resolution met with the Board for a two hour training on “Effective Meeting Management.” The training was aimed at making Planning Board meetings as efficient, productive, and informative as possible for applicants, board members and the audience.

It was moved, seconded, and SO VOTED, unanimously, by those present to accept the minutes of September 10, 2008.

The meeting adjourned at 9:50 PM.
