The new owner of 26 Summer Street, John Kenny, came before the Board on behalf of himself and his partner, Dana Baxter to discuss their future plans for the property. They currently the same permit issued to Mr. Hastings to develop the site with an 8,600 s.f. building and 32 slips. Per the Planning Board's March 2009 decision, they can have up to 14 additional slips on a temporary float under a 10A license issued by the Harbormaster until such time that a building permit for the new building is issued.
The owner is thinking of changing the plans for the property to include a larger marina (50 slips) and a significantly smaller building (6000 s.f.). In the short term, they are looking for a go-ahead to modify their Chapter 91 License by driving three new piles and increasing the number of slips as soon as possible so that they can properly plan for next year.
Board members explained that they cannot approve the sign-off on the Municipal Zoning Certificate until such time that the owner has either modified or rescinded the permit to reflect a smaller building. Mr. Baxter acknowledged this, and stated that he was committed to working with the Town on this project.

Present for the Applicant: Scott Cohen and John John Kiely-Hawthorne Partners; John Flatley and Dick Cain-Flately Companies; Theo Kindermans-Landscape architect, Stantec Inc.
Scott Cohen of Hawthorne Partners came before the Board to discuss proposed development plans for a for-profit, specialized residential facility for Alzheimer's patients to be located at the corner of WB Terry and Beal Street. Mr. Cohen currently has the property under agreement
Mr. Cohen explained that the project focuses on a more progressive treatment regime, encouraging patients live as normal a life as possible including things like doing their own regular chores (laundry, cooking if possible) and other activities as a way to slow the deterioration of their condition. The project is proposed for the 5-acres parcel near Stop and Shop, and will entail a one-story, 40+ units (units consist of a room and bathroom clustered in neighborhoods of 15, with shared dining and living room type space) on that site.
Mr. Cohen noted that the current zoning (Industrial and Industrial Park—it is a split lot) does not allow this use, which is currently permitted under Section III-A, 3.8 in all residential zones, as well as Office Park, but not Industrial or Limited Industrial. Mr. Cohen said that they could ask for a use variance, but they would prefer that the Town modify the zoning to allow this use in the Industrial and Limited Industrial Park.
Board members expressed interest in the project, and acknowledged that there was a need for such a facility. They told Mr. Cohen that they would take his request regarding a modification of the zoning under further consideration later in the meeting when they were discussing zoning.

The Board voted to submit the following proposed amendments to the Zoning By-Law to the Selectmen on December 1, 2009. Public Hearings will commence in January 2010.
ARTICLE 1: Will theTown amend the Zoning By-Law of the Town of Hingham, adopted March 10, 1941, in the"Zoning Map, Part A, Town of Hingham", both as heretofore amended, by removing from the Waterfront Business District and Including in the Official and Open Space District,the .51-acre property at 16 Summer Street, Assessors Map 51 Lot 3.

ARTICLE 2: Will the Town amend the Zoning By-Law of the Town of Hingham, adopted March 10, 1941, as heretofore amended, as follows:
Item 1:At Section I-D, Subsection 1, delete the last sentence in its entirety.
Item 2:At Section I-D, delete Subsection 4 (addressing fees) in its entirety.
Item 3:At Section I-J, delete Section 2 in its entirety and replace with the following: "2. Peer Review and Consulting Fees: The Provisions of Section I-F, 3 shall apply for all applications for a Special Permit A-3."

To amend the By-Law as needed to create a Hingham Harbor Overlay District, including the purpose, applicability, permitted uses, dimensional requirements, and any other special requirements or provisions of such district, and to include the following properties: Hingham Assessors Map 50 Lots 49, 50, 51; Map 51 Lots 1, 2, 3, 4, 5, 58, 59.

ARTICLE 7: Will the Town amend the Zoning By-Law of the Town of Hingham, adopted March 10, 1941, as heretofore amended, as follows:
Item 1:At Section III-A, Schedule of Uses, at subsections 1.4, 1.5, 1.6, 1.7, add the phrase "Subject to the provisions of IV-E, Multi-Unit Development."
Item 2:At subsection 4.11A, replace the existing use description in its entirety with the following:"Automated Teller Machine (ATM): a walk-up or drive-up mechanized consumer banking device operated by a financial institution for the convenience of its customers, which can be located indoors in an access-controlled facility, or outdoors, with walk-up or drive-up access."
Item 3:At Section III-A, 4.17, "Retail Group", add 4.12A "Health Club" to the list of uses that can be included in a Retail Group.

At Section III-A, Schedule of Uses, review and amend, as needed, all uses permitted in the Office Park, Industrial, Industrial Park, and Limited Industrial Park Districts with the goal of reflecting current land use patterns and trends while protecting and promoting the best interests of the Town.

Item 2.At Section VI, Definitions, add a new definition for "Special Outdoor Event".
Item 3. At Section III-A, Schedule of Uses, add a new use, 3.7 (A) "Outdoor Concession" permitted as an Accessory Use to those uses permitted by Sections 3.5 and 3.7 with a Special Permit A2 in the Official and Open Space District.
