The Applicant, Robert Gonsalves, came before the Planning Board and Zoning Board of Appeals seeking a Special Permit A2 to operate a gourmet cheese shop and ancillary 15 seat sit-down/take-out restaurant in a portion of the Pride Building in Business District A. The proposed space (approximately 1000 sq.ft.) is at the end of the Pride Building where clothing retailer, Island in the Square was located. The proposed primary use is as a retail cheese and gourmet shop. In addition, the owner would like to serve sandwiches basically “to go”, though they would like to provide 15 seats for customer convenience. There will be no dishes or place settings; disposable plates and utensils will be available. There is a back door with a small loading area provided, along with a dumpster. According to the lease there is a small basement area that can be used for storage only. The property is on Town sewer, though they will need the appropriate licenses from the Board of Health.
Planning Board Members voted to waive the requirement for site plan review in light of the fact that the project included only interior work.
In terms of parking, the Planning Board also determined that a Special Permit A3 was not needed. The lease includes two dedicated parking spaces behind the Pride Building, and is grandfathered with two additional spaces from the previous retail use, for a total of four spaces, which complies with the requirements set forth in the Off-Street Parking regulations in the Zoning By-Law.
The Zoning Board of Appeals voted to grant the Special Permit A2 for the proposed retail/restaurant use.

The lessee (South Shore Medical Center) was represented by Attorney Jeffrey Tocchio.
The applicant seeks a Special Permit A2 to build-out a 4,800 sq.ft. general purpose laboratory with associated office space in Bays 14 and 15 of the existing commercial condominium building located at 35 Pond Park Road in the Industrial Park District.
The existing commercial condominium building is 47,800 sq.ft, divided into 20 bays of approximately 2,400 sq.ft. each. The applicant operates a private medical practice with 3 locations on the South Shore. The proposed use will operate as a central medical processing laboratory for all three offices.
There will be no direct patient visits; a courier will make deliveries to the unit 3-4x daily.
There is a water filtration system that is attached to all laboratory equipment which is to be installed in connection with the proposed use. All laboratory instruments and any effluent that may be generated from the proposed use have been tested by an independent testing laboratory and certified to contain no toxic or hazardous materials under required guidelines. The applicant also has an existing hazardous materials program and will be providing a Title V analysis, prepared by a professional engineer, to the Hingham Board of Health.
No alteration to the Property’s current storm water drainage system is contemplated by the proposed use.
In light of the fact that the building footprint and exterior appearance of the building is not changing, the Board voted to WAIVE the requirement for Site Plan Review.
The Planning Board found that the project is in compliance with the Off-Street Parking Regulations set forth in the Zoning By-Law, and no further relief is needed. The parking lot is striped for 136 spaces, including 3 handicapped spaces. Total parking requirement for the building as currently in use is 104 spaces; the proposed use will require 17, increasing the parking requirement to 121 spaces, leaving a surplus of 15 spaces and one vacant 2,400 sq.ft. bay.
The Zoning Board of Appeals voted to grant the Special Permit A2 for the proposed retail/restaurant use.

Chairman Judy Sneath announced that this article was withdrawn by the petitioners.
ARTICLES 5 AND 8
The Planning Board and ZBA continued their discussion of Articles 5 and 8 by proceeding with a thorough review of Section III-A (Table of Permitted Uses), with a focus on what is or is not permitted in the Office Park, Industrial, Industrial Park and Limited Industrial Park Districts.
Ms. Lacy provided an overview of the origins and intent behind each district, including a chronology of when they were created and modified.
ARTICLE 6
The discussion of Article 6 (to eliminate the existing provision to grant use variances) was postponed to the next joint meeting of the Planning Board and ZBA on February 1, 2010.
