Present: Planning Board Members, Judy Sneath, Chairman, Paul Healey, Clerk, and Gary Tondorf-Dick. Also present was Planner Katharine Lacy.

7:00 Request for Continuation-Baker Hill

Present for the developer, Ed Gill, Rich Andrukonis, and Attorney Robert Shelmerdine, Intoccia Company.

Intoccia Construction is requesting a continuation of the time permitted to complete the subdivision. Intoccia has received none extension since the project was approved in 2000.

Mr. Shelmerdine noted that the developer will also be seeking 2-4 building permits in the near future. At the time of the last continuation on December 1, 2009, meeting several residents of Baker Hill Drive expressed frustration at the time that it was taking to complete the subdivision, and, in particular, the time that it was taking to install the sidewalk and streetlights. In the intervening months, the sidewalk has been installed, as have the conduits and bases for the street lights, though the lights themselves have not yet been installed.

Ms. Lacy reported that she had engaged John Chessia to serve as a site inspector, and that Mr. Chessia had updated the “cost to complete” and identified those items that needed to be addressed immediately, in the short-term, and prior to street acceptance.

Baker Hill Drive residents implored the Board to not authorize the Town Planner to sign off on any building permits until such time that visible progress has been made on the project. Mr. Shelmerdine, in turn, noted that there was a significant cash flow problem, and that it would be difficult to come up with the money to fix things unless they were permitted to sell lots. He also pointed out that the lots in question had already been released by the Town.

Board members decided to continue the hearing until June 14, 2010, in order to give Intoccia some time to make some progress on the project before voting they would vote to extend the time for completion. In consultation with John Chessia and Town Planner Katy Lacy, the Board identified the following items that needed to be completed by June 14, before they would consider extending the time of completion for the project.

Replenish account for on-site and review inspector per condition V (13) of Subdivision Approval ($20,000)
Expose inlets at base of private driveways
Clean outlets and install rip-rap as needed
Clean and plant stormtreat units
Implement regular street sweeping program.
Restore/repair swale on south side of roadway
Pay back taxes

Review of Lighting Plan and Construction Management Plan

Present for the Applicant: Rod Gaskell and Al Trakimas, SITEC Engineering, Vcevold Strekalovsky, Architect; Brian T. Collins, Project Manager, Bowdoin Construction.

A condition in the 2009 Site Plan Approval for SSBC included a condition that the applicant submit for the Planning Board’s review and approval 1) A Building Lighting Plan, showing all exterior lighting fixtures, and 2) A Lighting Control Plan, outlining the hours of the day and days of the week when the lights in the front and back parking lot will be on.

Mr. Strekalovsky presented a building lighting plan showing that lighting would be limited to fixtures located under a roof or inside a porch entrance. The existing steeple will continue to be illuminated from Main Street. In term of the parking lot lighting, the regular setting for night lighting would be OFF. If lights were used, they would go off at 10:30 PM. Further, the lighting system would have an over-ride switch that would allow the outdoor lighting to be turned on throughout the parking lot, or only in the lot closer to the building.

It was moved, seconded and SO VOTED by all present to approve the lighting plan and schedule for South Shore Baptist Church submitted to the Planning Board April 14, 2010.

Rod Gaskell provided the Board with an overview of the construction schedule.

8:15 Request for Continuation-Fresh River Landing, Weathervane
Carl Erikson came before the Board on behalf of the Bristol Brothers to request an extension to the time of completion for the Fresh River Landing Subdivision on Fort Hill Street, and the Weathervane Flexible Residential Development at 119 Beal Street.

The current date of completion for Fresh River Landing is June 10, 2010. Mr. Erickson provided evidence that the roadway bond, held in favor of the Town, was extended to June 15 2011. It was moved, seconded, and SO VOTED by all present to extend the time of completion for the Fresh River Subdivision to June 1, 2011.

The completion date for Weathervane expired on May 1, 2010. Mr. Erickson noted that had spent a considerable amount of time during the past year changing the form of ownership from a condominium to individual lots, and lifting the age restriction. They have also built one model home and are prepared to build another this year. Board members expressed concern that the project was taking so long, and so little progress had been made since the project was approved.

There is no bond or surety on this roadway as the project approval stipulated that this will always be a private roadway. It was moved, seconded, and SO VOTED by all present to extend the time of completion of the Weathervane FRD to November 1, 2011.
