Present: Planning Board Members, Paul Healey, Sarah Corey, Judy Sneath, and Gary Tondorf-Dick. Also present was Planner Katharine Lacy.

7:00 PM 0 Ward Street - The Ward Street Turf Fields Fund
The Applicant has submitted a letter dated October 6, 2010 requesting a withdrawal without prejudice. The withdrawal was required due to a lack of quorum on the part of the Planning Board for one or more hearings. They have also resubmitted the application for a hearing on November 1.

It was moved, seconded and SO VOTED to approve the request to withdraw the Application for a Special Permit A3.

7:10 PM 987 Main Street - Sprague Court
The applicant has submitted a letter dated October 18, 2010, requesting a withdrawal of the application for Definitive Subdivision Approval submitted June 9, 2010.

After a brief discussion, it was moved, seconded, to DENY the plan entitled “Sprague Court, Definitive Subdivision Plan of Land, prepared by James Engineering, Inc. 125 Great Rock Road, Hanover, Mass, dated February 4, 2010 and revised August 8, 2004 and September 24, 2004 consisting of Sheets 1-6 (the “Plan”) for Michael K. Grehan, 31 Summit Avenue, Quincy, MA (the “Applicant”). Such denial was based on the following:

1. In a letter dated October 18, 2010 (attached) the Applicant requested a withdrawal of the above referenced application.

2. The Plan submitted to the Board of Health for review per M.G.L. Chapter 41, Section 81U was not the same as the Plan submitted to the Planning Board in the “Application for Approval of Definitive Subdivision Plan, thus rendering this submittal requirement set forth in Section 3.C (3) of the “Town of Hingham Planning Board Rules and Regulations Adopted under the Subdivision Control Law as Amended through August 29, 2005 (the Subdivision Regulations) incomplete.

3. The Plan included two alternative roadway layouts, neither of which fully complied with the current version of the Subdivision Regulations, as follows:

A. The plan titled “Alternative Right of Way Layout” failed to meet the following provisions of the Subdivision Regulations: Section 3.C (2) n (submittal requirement for roadway profile); Section 5.D (minimum of 2.5 feet of cover over storm drains); Section 4B, Table 1 (minimum centerline grade); Section 4.C (3) b (requirement for manholes at intersection of two drain lines).

B. The plan titled “Grading Plan, Sprague Court” failed to meet the following provisions of the Subdivision Regulations: Section 4B, Table 1 (minimum centerline radius); Section 4.B. (3) a (minimum vertical curve); Section 4.B (3) c (minimum angle of intersecting roadway); Section 4.B (3) f (maximum grade of approach grade from existing edge of pavement); Section 4.B. 4(b) (minimum cul-de-sac radius and cul-de-sac layout); Section 4.C (3) a (requirements for paired catch basins); Section 5(M) (maximum side slopes).

8:00 PM Follow up on Conditions for Flexible Residential Development
191 Beal Street-Weathervane at Chestnut Gardens

Present for the Applicant: Jim Bristol and Carl Erickson, Bristol Brothers Construction

Mr. Erickson provided a mylar of a plan revised per vote of the Planning Board dated September 28, 2009. This plan will be signed when the Board receives the revised Homeowner’s Agreement and Covenant for the development.

There was further discussion of proposed irrigation pond at Weathervane at Chestnut Gardens. Board members expressed safety concerns. Mr. Bristol agreed to a limited amount of fencing, but wanted the pond to remain fully visible as a landscape feature. Nothing was resolved.


Old/New Business

Form A - 20 Woodlock Road
This Form A combines three lots into a single lot of 66, 284 square feet. All three sub-lots are in common ownership; the purpose of the consolidation is to create a lot that conforms with Zoning and Board of Regulations for a residential lot.

It was moved, seconded and SO VOTED to endorse the Form A plan entitled “Plan of Land Located at 20 Woodlock Road, Hingham, MA” dated 10/01/10, prepared by Edward T. Eisenhaure, PLS, Hingham, MA, prepared for Shepard Investments, LLC.

Form A - 1 Le Clair Drive and 193 Cushing Street
This Form A shifts the rear lot line between two properties currently in common ownership. The resulting two lots would both comply with zoning.

It was moved, seconded and SO VOTED to endorse the Form A plan entitled “Plan of Land
1 LeClair Drive & 193 Cushing Street, Hingham, MA” dated 10/8/10, prepared by Neil J,Murphy Associates, Inc., Cohasset, MA, prepared for Brian & Christine Wilk.


The Board voted to approve the minutes of October 4, 2010

The Meeting was adjourned at 8:45 PM.
