7:00 Discussion of Proposed Amendments to the Zoning By-Law

Present: Planning Board Members, Sarah Corey, Susan Murphy, Judy Sneath, and Gary Tondorf-Dick. Also present was Planner Katharine Lacy.

The Board was joined by Advisory Committee Liaisons Mary Power, Greg MacCune, and Richard Innis.

The Board discussed various proposed amendments to the Hingham Zoning By-Law. It was moved, seconded, and SO VOTED to submit the following proposed amendments to the Selectmen for consideration at the 2011 Town Meeting.

1. To Review and Update Use Table

Article Will the Town amend the Zoning By-Law of the Town of Hingham, adopted March 10, 1941, as heretofore amended, as follows:

At Section III-A, Schedule of Uses, review and amend, as needed, all uses permitted Residence District A-E; Business A, Business B, Waterfront Business, Waterfront Recreation, Business Recreation and Official and Open Space Districts, including amendments to associated definitions in Section VI as needed, with the goal of responding to current land use patterns and trends while protecting the long-term best interests of the Town, or act on anything related thereto?


2. To Amend Dimensional Requirements for Business B

Article Will the Town amend the Zoning By-Law of the Town of Hingham, adopted March 10, 1941, as heretofore amended, as follows:

For parcels located in Business District B, modify Section IV-A ( Schedule of Dimensional Requirements) and Section IV-B (Special Dimensional Requirements), with the goal of improving the appearance and safety of properties within this district; responding to current land use patterns and trends, and protecting the long-term best interests of the Town, or act on anything related thereto?


3. Update Reference to Flood Plain Map

Article Will the Town amend the Zoning By-Law of the Town of Hingham, adopted March 10, 1941, as heretofore amended, as follows:

At Section III-C (Food Plain and Watershed Protection Overlay District ) subsection 1, update the reference to the Hingham Flood Insurance Rate Map (FIRM) to reflect the date of the most recently created map provided to the Town by FEMA, or act on anything related thereto?


4. Amend Definition of Street

Article Will the Town amend the Zoning By-Law of the Town of Hingham, adopted March 10, 1941, as heretofore amended, as follows:

At Section VI (Definitions), clarify the definition of “Street” to better conform with Massachusetts General Law, or act on anything related thereto?



Old/New Business

1. The Board voted to sign Certificate of Completion for Hersey Estates, which was first approved in 2001 and recently received its final coat of paving. This is a private roadway that will be maintained by a Homeowner’s Association.

2. Ms. Corey signed the Site Plan Decision for 100 Sharp Street (Tricorp).

3. Ms. Lacy announced that the next Planning Board meeting is December 13 at 7:00 PM
