Public Hearing - Restaurant Common Victualler All Alcoholic Beverages License of Ocean Kai, Inc.
Mr. MacIver explained that the purpose of the hearing is to determine if the Town should modify, suspend or revoke the Restaurant Common Victualler All Alcoholic Beverages License issued to Ocean Kai.  Mr. MacIver reviewed the recent violations at the Ocean Kai noting that this was quite a record for six months and that Mr. Chin's response to date doesn't reflect the Board's level of concern.  Mr. MacIver noted that this record could be indicative of a pattern of over-service in the bar.   Mr. Sullivan, attorney for the Ocean Kai, noted that Mr. Chin and his family have operated this business for 34 years.  Two years ago the restaurant was extensively renovated.  Recently significant money has been expended for a high tech machine that analyzes a driver's license for authenticity.  It is their intention to be good managers and not to over-serve.  Mr. Sullivan also stated that in some of the instances patrons came in, became belligerent and refused to leave.  Mr. Chin has a person working security on weekends; he will have two people on Saturday night because it is the busiest night of the week.  The individuals are TIPS and security experienced.  The operation has improved over the years and the Chins are trying hard to not have an atmosphere where the police would need to be called.  Historically the clientele at the Ocean Kai has been younger than that at other restaurants in town.  Mr. Chin has improved the restaurant in an attempt to upgrade the clientele.  The parking lot seems to be a place where a lot of this activity takes place.  The parking lot is well lit, paved, lined.  Mr. MacIver suggested written operating procedures and refreshing the training of personnel.   He further suggested that it would be possible to continue the hearing to allow Mr. Chin more time to come up with a program of specific activities to address these issues.  Mr. Edmundson concurred noting that it would be helpful to see what the steps were being considered, etc.

Voted - to continue the public hearing on the Restaurant Common Victualler All Alcoholic Beverages License of Ocean Kai until December 13, 2005 at 7:30 PM.

Public Hearing/Grant of Location - Verizon to locate pole on Kilby Street and relocate a pole also on Kilby Street
Ms. Kane of Verizon explained this is necessary to maintain clearance of the railroad gates and to better align poles and cables.  She noted that at some point in the past a pole on this line was lost.  This will allow re- establishment of the Verizon pole line on Kilby Street

Voted -  to approve the Grant of Location on the petition of Verizon New England Inc. No. 11/05/21, dated 11/22/2005 to place one new pole, Pole #16 on Kilby Street approximately 126' easterly of existing Pole #14, and also to relocate Pole #17 approximately 12 feet westerly of its existing location.  This petition was submitted at the request of the MBTA to provide additional clearance for railroad gates and to better align poles and cable. 

The residents of 57 Kilby Street entered the meeting just after the Verizon representatives left the hearing.  The Bleidorns explained that they were unable to find the correct meeting room.  They expressed great concern of the proposed location of the pole, which would be directly in front of their home.  The Board will have a call made to Verizon and request that there be some further discussion on this matter.  It may be possible to move the proposed pole closer to pole 14 or across the street.

Semi annual report from the Country Club Management
Mr. Walsh advised that the irrigation system is about 95% complete.  The pumps are in the ground and functioning.  Water reaches parts of the course that have never been irrigated before.  A third party is maintaining the course.  Calendar year 2006 is the last year of the current contract.  The Committee is working on a long-range plan for capital improvements.  The Committee would also like to see the nearby train stop called Country Club Stop and would like to contact MBTA to see if this is possible.  The CCMC has been working with MBTA on drainage concerns since water has been backing up along the right of way.  They are also working closely with the contractor for the banquet and food service.  The facilities study is underway - a firm has been engaged to look at the physical structures and the systems and to itemize repairs and improvements to bring things up to where they should be.  The Long Range Planning Committee for South Shore Country Club is looking at ways to best utilize the facility.
