Continuation of the Public Hearing on Ocean Kai Common Victualler All Alcoholic Beverages License
Mr. Sullivan, representing the Ocean Kai, presented the Board with a letter requesting the hearing be continued until such time as Chief Carlson and his representatives have had time to meet and discuss revised security arrangements, etc.  Mr. MacIver reviewed the discussion from previous meeting and the incidents that created a need for the hearing.  The Board had recommended that Mr. Chin and Mr. Sullivan speak to the Police Chief.  Mr. Sullivan had been unable to discuss the issues with the Chief until today and Chief Carlson would like an opportunity to make a site visit.  Mr. Edmundson suggested that they speak about internal security and the security in the parking lot.  He said he would be willing to follow the Chief's suggestion that this matter be carried over to January.  Mr. MacIver agreed noting that the Police Department can make suggestions to bring the operational aspect up to the standards of other places in town. 

Voted - to continue the hearing on whether to suspend the Restaurant Common Victualler All Alcoholic Beverages License of the Ocean Kai until January 3, 2006 at 7:35 PM.

Tax Billing and Collection Computer System
Mr. Alexiades, on behalf of the finance officers, asked the Board to support the budget recommendation for replacement of the tax billing and collection computer system.  This is actually a three-year MUNIS package which requires acceptance prior to December 31.  The choice of vendors was narrowed down to Data National, Customized Data Service and MUNIS.  Data National would cost $27,000 in the first year.  As for functionality, Data National is a small local company that served the Town well for a number of years.  The server is 10 years old and there have been problems finding replacement parts for it.  If the Data National server were to be upgraded it would continue to operate on UNIX basis and the town does not have any UNIX expertise.  Every other operation in the building is on windows based platform.  MUNIS allows modification of Assessors' file on an as-needed basis; Data National allows modification only twice a year.  MUNIS has a forms processing capability and sells a program that allows printing any form on blank paper.  MUNIS also offers a disaster recovery program. Currently the Town uses MUNIS for payroll, financial statements and accounts payable. Mr. Edmundson asked why this was coming forward now.   Mr. Alexiades explained the Ms. Montgomery and Mr. Partridge started looking around last fall after several failed attempts to get a fix for the Data National program and server. 

Housing Partnership Proposal
Mr. O'Brien reviewed the proposed RFP which had been prepared at several Housing Partnership meetings.  The current timeline would be to have the RFP available at the end
of January with a return in March but if it is necessary those dates could be extended.  Mr. MacIver asked about the Boundary of the northern portion of the parcel as shown on the plan.   He explained that the Town owns the railroad right of way but the tracks are owned by an entity that is unknown at this time.  The shipyard has an easement where the tracks are.  Mr. MacIver said if the Town were to retain the railroad right of way and pull back the boundary to the right of way the developer could be given an easement.  There are a number of issues that need to be reviewed.

Voted - to authorize the expenditure of $20,000 from the residential inclusionary development fund required by the special permit for Canterbury Estates for engineering for the Housing Partnership development of the Beal Street/Selectmen's property.

Voted - to accept the proposal in principle and enter into negotiations for a short-term non-exclusive lease agreement with Lincoln Maritime Center for Barnes Wharf.

Voted - to accept the proposal in principle and enter into negotiations for a short-term non-exclusive lease agreement with Lincoln Maritime Center for Barnes II/Steamboat Wharf.

Mr. Cristello advised that Representative Bradley had contact the Alcoholic Beverages Control Commission counsel to get his view on an extended closing of the Hingham Bay Club.  This sort of thing happens frequently enough that the ABCC has no problem with that.  For the ABCC, it is a whole separate class and would not create a precedent.  At a future meeting the board will consider the merits of the renewal for the Bay Club.

Voted - to grant the Naked Fish Restaurants, Inc., d/b/a Red Sauce, 48 Whiting Street, permission to remain closed for an additional three months, to allow time to transfer the Restaurant Common Victualler All Alcoholic Beverages License.  (The previous request for a transfer was withdrawn and Naked Fish has entered into a new agreement with a different entity.)

Mr. Cristello explained that the Town has been under-billing ambulance service.  An few years ago the policy was adopted to bill Medicare rates.  The actual cost of transport is actually 30% above the Medicare rate.  The Town will continue to accept the Medicare payment and not balance bill Medicare patients.

Voted - to adopt an ambulance billing policy of "Medicare plus 30%".

Reports
There were approximately 200 people at the town holiday party last Friday night.  Good wishes to Tony Rizzotto who broke his foot.  Hingham DPW came in second in the recent  "snow plow rally".  Ms. Tully noted that the sidewalks downtown need some follow-up.  Mr. MacIver said several people have given him thoughts on plowing of sidewalks and that he would like a memo from Mr. Stigliani on a sidewalk plowing policy.
